By engaging the services of Blue Water Pool and Spa (‘the Company’), the Client acknowledges and agrees to the following terms:

No Liability for Injuries or Damages:

1.\tThe Company shall not be held responsible or liable for any personal injury, death, property damage, or other loss or harm occurring in, on, or around any swimming pool, spa, or surrounding premises serviced, maintained, chemically balanced/treated, or repaired by the Company, whether such injury or damage occurs before, during, or after the performance of services, except to the extent caused by the gross negligence or willful misconduct of the Company.

Assumption of Risk:

2.\tThe Client acknowledges that the use, maintenance, and presence of swimming pools and spas inherently involve certain risks, including but not limited to drowning, slips, falls, electrical hazards, chemical exposure, chemical reactions, or improper chemical handling. The Client voluntarily assumes full responsibility for all risks of injury or damage to persons or property arising out of or related to the use or condition of the pool or spa.

Client’s Duty of Care:

3.\tThe Client is solely responsible for ensuring that all persons, including but not limited to family members, guests, tenants, and invitees, exercise appropriate caution and supervision when in or around the pool or spa area. The Client is also responsible for ensuring compliance with all applicable safety standards, fencing requirements, local regulations, as well as for the proper storage, handling, and application of the pool and spa chemicals.

Indemnification:

4.\tThe Client agrees to indemnify, defend, and hold harmless the Company and its owners, employees, agents, and subcontractors from and against any and all claims, demands, losses, liabilities, costs, or expenses (including attorney’s fees) arising out of or related to the use, operation, or condition, cleaning, chemical balancing/treatment of the pool or spa, except to the extent caused by the gross negligence or willful misconduct of the Company.

1. Service Overview

Blue Water Pool and Spa provides routine maintenance, equipment repairs, chemical balancing, and installations. Each service visit is performed by trained technicians focused on quality and safety.

2. Service Agreement

All ongoing maintenance or project work requires service agreement that includes:

Description of services
Frequency and schedule
Pricing and payment terms
Reviewing the Cancellation policy (see cancellation policy)

3. Scheduling & Access

We schedule visits within set service windows.
Clients must ensure clear access to pool/spa areas.
If we can’t access the property, a trip fee will apply.
See ‘Cancellation Policy’

4. Payment Policy

Payment is due in full upon completion of service unless otherwise agreed upon by the client and management of the company.
Accepted payment methods: Cash, Credit/Debit (transaction fees apply), cashier’s check. (Possibly Venmo at a later date)
Late payments may incur a late fee of 10% of the remaining bill after 30 days from the agreed upon date of payment.
New installations or equipment orders may require a deposit which will be agreed upon when the job is discussed between client and company.
A discount of 2% for cash payments of sales and services under $1,000.00.
In the event any payment tendered by the client is returned, dishonored, or rejected by the client’s financial institution for any reason, the client shall be fully responsible for all resulting fees, charges, and expenses incurred by the company, including but not limited to returned check fees, bank charges, administrative costs, and any collection-related expenses. Additionally, repeated issues can cause compounding actions up to, but not limited to, termination of contacts or services provided by the company.

6. Warranty & Repairs

Equipment installations and repairs carry a 30-day workmanship warranty.
Manufacturer warranties apply where available.
Damage due to misuse, neglect, or unapproved alterations is not covered under the above stated workmanship warranty.
Used/Repaired items have a 30-day warranty with Blue Water Pool and Spa.

7. Water Treatment & Chemical Policy

Technicians test and balance water according to professional standards.
After chemical treatment, please wait at least 30 minutes before swimming.
Blue Water Pool and Spa is not responsible for water chemistry issues arising from customer-added chemicals; or long timeframes between company services.

8. Property Care

We take every precaution to protect your property. However:

Please secure pets and valuables before scheduled visits.
Notify us of any access restrictions or special instructions.
In the rare event of accidental damage, we’ll document and address it promptly.

9. Liability

Blue Water Pool and Spa is insured.
See ‘Liability Disclaimer and Assumption of Risk’ prior to work being done.

10. Customer Communication

We communicate primarily via phone or email.
Clients will be notified of major findings or needed repairs during service, prior to repairs being done.
Feedback is always welcome - we aim for 100% satisfaction.

11. Privacy Policy

We respect your privacy. Client information is stored securely and never shared with third parties, except as required by law or with your consent.

12. Complaint Resolution

If you’re ever unhappy with a service:

Contact us within 48 hours of the visit.
We’ll review and, if necessary, revisit the property to correct the issue.
Refunds or adjustments are handled case-by-case and are under the discretion of management.

13. Environmental Commitment

We follow proper chemical disposal, water conservation, and eco-friendly cleaning methods whenever possible.

Purpose

\tThis policy explains how job cancellations and rescheduling are handled for all Blue Water Pool and Spa (the company) services, including maintenance, repair, and installation work. The goal is to keep our schedule running smoothly, respect our technicians’ time, and provide fairness for all clients.

1. General Expectations

When you schedule service with the company, we reserve that time exclusively for you. Our technicians plan their routes, materials, and labor around confirmed appointments. We understand that plans sometimes change, and we do our best to accommodate adjustments when possible.

2. Standard Cancellation Notice

Clients must provide at least 48 hours’ notice (2 full business days) to cancel or reschedule any scheduled service appointment.
For larger service/projects (installations, equipment replacements, or multi-day jobs), 120 hours’ notice (5 full business days) is required.

\tCancellations made within the required notice period will not incur any fee with the exception of non-refundable deposits.

3. Late Cancellations

\tIf a cancellation occurs less than 48 hours (or 120 hours for large service/projects) before the scheduled start time:

A Late Cancellation Fee of $50 or 20% of the scheduled service value (whichever is greater) may be charged. Service will not commence until the fee has been paid.
If the technician is already en route or arrives on-site, the visit will be charged as a Trip Fee of $75 or 20% of the scheduled service value (whichever is greater), to cover travel and lost time.

4. No-Show or No Access

\tIf our technician arrives and cannot perform the job due to:

Locked or blocked gates (unless giving access codes/key access),
Loose or aggressive pets,
Unreasonably inaccessible equipment,
Client not home (when access is needed), or
Unsafe working conditions.

\tThe visit will be treated as a Late Cancellation, and a Fees of the Late Cancellation (3.) section of this policy will apply. If the service was pre-paid or part of a package, one visit credit may be forfeited. This fee is under the discretion of the company.

5. Weather-Related Cancellations

\tSafety comes first. Blue Water Pool and Spa may delay or cancel work due to unsafe weather conditions such as lightning, heavy rain, or high winds.

If the company cancels due to weather, there will be no charge, and the service will be rescheduled as soon as possible.
If a client requests to cancel due to light or moderate weather that does not prevent safe work, the normal Late Cancellation (3.) section of this policy (including fees) applies.

6. Emergency Rescheduling

We understand that emergencies happen (family illness, property issues, etc.). In genuine emergency cases, the company may waive Late Cancellation (3.) fees at management’s discretion. Repeated short-notice cancellations may still result in an adjustment of service scheduling (if the work is a multiple service agreement). Please reach out to the management team via email or by phone in regards to this.

7. Ongoing Maintenance Clients (contracts)

\tFor customers on regular weekly or biweekly service plans:

One courtesy cancellation per season is allowed with proper notice.
Ongoing skipped or canceled visits may affect water quality and equipment performance.
The company cannot be held responsible for chemical balance or water clarity if service is interrupted by client choice.

8. Installation and Project Work (larger service/projects)

\tFor contracted installation or renovation jobs:

A non-refundable deposit is typically required to secure scheduling and materials. Which will be determined during the consulting process and written in the job estimate.
Cancellations made more than 7 days before the project start date will receive a refund of payments made, minus the non-refundable deposit and any special-order materials already purchased which would have been used for the project.
Cancellations made within 7 days of the start date may forfeit up to (but not limited to) 50% of the total project cost, depending on materials ordered and labor scheduled.

9. Rescheduling Policy

Clients may reschedule a job without penalty if proper notice is given within 48 hours or 120 hours (depending on job type). Rescheduling requests are accommodated based on technician availability. The company will always strive to find the next available opening that works for both parties.

10. Company-Initiated Cancellations

\tIn rare cases, the company may need to reschedule or cancel a job due to:

Equipment or vehicle failure,
Weather or safety issues,
Staffing shortages, or
Supply delays. (including but not limited to third party contractors)

\tWe will notify clients as soon as possible and provide a new service date. Clients will not be charged for company-initiated cancellations.
